Many Who Live At Bay Pines Are Veterans Dependent On Veterans Hospital

Residents of the sprawling 507-unit Bay Pines Mobile Home Park, many of them dependent on nearby Bay Pines VA Healthcare System, on May 25 were served with eviction notices that could mean losing their homes by Nov. 30.

The adjoining Bay View Mobile Home Park, a rent-only facility, also is affected by the pending evictions.

It was not known when tenants, who get no civil or government relocation support, must leave.

A park security guard and an unidentified woman in a golf cart went from trailer to trailer at Bay Pines posting the eviction notices on doors.

Many residents are out-of-state trailer owners, some Canadians, who might not be aware of the evictions.

The notices came just days after real estate developer John Loder closed on the properties. Though conjecture was high that high-end condominiums would be built, a press release from Loder said that no definitive plan has been reached for the future use of the site.

Leo Plenski, a retired Philadelphia steelworker and president of the Bay Pines Mobile Park Homeowners Association, said the notices should have been served by process servers or certified mail.

Plenski, a 15-year Bay Pines resident who also heads Floridians Against Injustice to Residents of Mobile and Manufactured Homes or F.A.I.R., said he contacted the Pinellas County Sheriffs Office over how the notices were delivered.

Plenski charged that the notices are the start of a scare campaign to force out residents.

On the one hand, they were fixing to move. On the other hand, they were fighting to stay.

Things have been simmering in Bay Pines Mobile Home Park, as some residents packed up and left and their mobile homes were marked with a large V. Others considered their options with the help of relocation services provided by the developer. Others still held out for some relief from the courts, as the homeowners association sues the seller and buyer for damages.

Things were looking pretty good for the homeowners. On July 21, Circuit Court Judge Walt Logan didnt throw out the complaint, which they found encouraging. He ordered the attorney to fix it. He gave him 10 days, the first working day being Monday, Aug. 7, to file an amended complaint.

During the week that followed the order, the associations lawyer, John Thomas, indicated to the association president, Leo Plenski, that he might be dropping the case for business reasons, Plenski said.

On Aug. 7, Thomas e-mailed Plenski to tell him he was trying to get an extension on the deadline to file an amended claim to give the homeowners association a chance to hire a new lawyer.

The court docket shows that, on Aug. 7, a motion to withdraw, and an emergency motion to extend the time to file the amended complaint, was registered.

Leo Plenski expected the first eviction notice he received after Bay Pines Mobile Home Park was sold, but he was outraged to get a second eviction notice alleging he was two months behind on his rent. He has the canceled checks to prove he paid on time.

Plenski, head of the Bay Pines Mobile Home Park Homeowners Association, was not the only one to receive such an eviction notice. At least one other family that had paid its rent also received a letter threatening eviction.

Plenski said he thinks the letters are a form of harassment designed to scare people into leaving the park instead of fighting for their rights. The association, which Plenski heads, filed a lawsuit after the park’s sale alleging the homeowners have a right to remain in the park until 2020.

“They’ve not had the property 2 weeks. I don’t know where they’re getting all this information,” Plenski said. “It’s just harassment.”

Plenski said the association has amended its lawsuit to include new owner John Loder and charges of harassment. The association’s attorney, John Thomas, sent two letters to attorneys for the park’s new owner alleging other “harassment” that includes “trying to force a buyout of the residents’ leasehold interests using threats and intimidation.”

The June 7 eviction letters were signed by Stanley L. Martin of the Ruden McClosky law firm. He did not return a phone call seeking comment.
