Brian Kabateck announces $56.4 million settlement for Friendly Village Mobile Home Park residents

Friendly Village mobile home park will remain both a park and affordable for its residents following King County Housing Authoritys recent purchase of the community.

The age 55-plus, 40-acre park at 18425 N.E. 95th St. in Redmond was put on the market several months back, before the Housing Authority purchased it.

The Housing Authority took over operations of the park on Nov. 1

Rhonda Rosenberg is the director of communications for the Housing Authority, and said the prior owners wanted to preserve the property as a mobile home park.

What were really delighted about is that they wanted to maintain it as a mobile home park for the people that were there instead of selling to a private developer, she said.

The Housing Authority paid $25 million for the park, which consists of 224 mobile home pads, putting the price of each pad at roughly $111,000.

Residents own their homes, but pay on average only $782 a month for a space in the park. Thats far lower than rent elsewhere in Redmond and Puget Sound.

Rosenberg said if a private developer had bought it, even one that would keep it as a park, rent prices would have likely ballooned. This presents a problem for the seniors who live there, many of whom are on fixed incomes.

We dont have a profit motive, like a for-profit private developer, Rosenberg said.

Long-time resident of the park Arthur Ingalls echoed those thoughts.

Theyd have two or three hundred senior citizens on their hands, Ingalls said.

31 Families Awarded $34 Million in Punitive Damages

Tue, Nov 27, 2018 A jury decided today that the owners of Friendly Village Mobile Home Park in North Long Beach should pay out $34 million in punitive damages, in addition to $5.5 million awarded last week, to residents of the park who sued over decaying conditions that included methane gas leaks and continually sinking ground.

The jury awarded the punitive damages for negligence, unfair business practices, retaliatory eviction and financial elder abuse. Lead attorney Brian Kabateck said the residents lived in squalor at the property that was once a trash dump for the city of Long Beach.

This is an outstanding outcome,â Kabateck said Tuesday. âWhat we really hoped for is that justice would be done.

He said this case, which involves 31 families, is the first suit. The law firm plans to file another lawsuit on behalf of 120 families who live in the 182-unit park, which is just south of Davenport Park on Paramount Boulevard.

Kabateck said the bulk of the judgment was against Kort & Scott, which own a number of mobile home parks across the state.

    Mon, Mar 1, 2021 Creating a new chapter in the complicated history of Friendly Village MHP Associates, L.P., Force 10 Partners served as court-appointed financial advisors to secure a stalking horse bid and purchaser of the property, resulting in an $11 million transaction.

    To attract the highest bidder, Force 10 communicated with more than 200 potential purchasers/bidders and managed a complex due diligence process for the sale, which entailed financial, real property, engineering, and geotechnical material.

    ACI Friendly Village, a newly formed California nonprofit public benefit corporation, won with a $11 million bid. ACI Friendly Village was created by Affordable Communities, Inc. and affiliated companies, which acquire and manage mobile home parks to preserve affordable housing. ACIs principal, Maurice Priest, told the court that he intends to manage, operate, and maintain the property, so that families can continue to live there and not lose the investment they have made in their homes.

    After tenants sued Friendly Village MHP, it filed for Chapter 7 bankruptcy protection in October 2018. A $56.4 million settlement in November 2019 resolved the lawsuit. Together with other proceeds, the sale will fund the settlement.

    Residents Of Friendly Village Mobile Home Park Win $57mm Settlement

    Wed, Nov 20, 2019 The owners of a mobile home park that is sinking due to its location on a former landfill have agreed to pay roughly $50 million to 151 families who sued over the conditions, an attorney representing the residents announced today. He made the announcement after a judge approved the settlement earlier this week.

    As part of the agreement, residents in the park on Paramount Boulevard will also share in a portion of the proceeds from the sale of Friendly Village Mobile Park after the owners declared bankruptcy. The sale is expected to generate an additional $7 million to be divided among the residents, even those who were not part of the lawsuit that culminated in a civil trial and jury verdict a year ago.

    Phil Woog, an attorney for the parkâs owners Friendly Village MHP Associates, Sierra Corporate Management and Kort & Scott Financial Group declined to comment in a brief phone interview.

    Kabateck and his partner, Gary Fields, said the settlement will be divided among residents based on their individual conditions. None of the residents will get rich, he said but he said hopes it will be enough to help them find a new home.

    Estimated Awards: $57,000,000 $25,650,000 = $31,350,000 ÷ 151 families = $207,616 per family, but only if it were divided equally which is NOT how it will work. This calculation is only provided as an example and does not reflect the actual individual settlements to be awarded to the 151 families.

    350 residents of Friendly Village Mobile Home Park who live in squalor will receive monetary compensation from the owners of the park, who failed to address serious maintenance problems, ignored complaints and hiked up the rent.

    A bankruptcy judge approved a $42.5 million settlement for 151 families who filed lawsuits against the defendants, Michael Scott and Lee Kort. Those plaintiffs obtained $6.9 million paid from prior settlements.

    As part of the settlement agreement, the mobile home park will be sold and a substantial portion of the proceeds of that sale, at least $7 million, will be divided between many of the residents, even those who are not part of the litigation.

    This landmark agreement resolves litigation that found the owners negligent of unfair business practices, retaliatory eviction and financial elder abuse.

    Owners of a Long Beach mobile home park that is sinking agreed to pay more than $50 million to residents who sued over deplorable conditions.

    LONG BEACH, Calif. — More than a hundred families living in a Long Beach mobile home park that is sinking won a major legal battle Wednesday.

    The owners of the mobile home park agreed to pay more than $50 million to those families who sued over the deplorable conditions.

    Sharlynn Galvan has lived in her home at the Friendly Village Mobile Home Park for 26 years, but she said the last several years have been a nightmare.

    “It’s been a disaster and I just try to ease myself with my friends and my caretaker,” said Galvan.

    Residents, many of the older and low income, have dealt with infestation of rats and mice.

    Shifting land beneath the units built on a former landfill has caused problems, including sewage backups and flooding.

    Residents say their complaints were ignored and instead of making repairs, they say management increased rents about 50%. They sued the owners and won.

    “These people paid their money on time and got nothing in return except the park that went from bad to worse,” said attorney Brian Kabateck.

    Attorneys announced a $57 million settlement that will benefit 151 families who filed lawsuits.

    “Now I can move on with my family and don’t have to live in this crisis anymore,” said Leonard Camrena, the president of the Homeowner’s Association.
